高庭撤销大股东诉讼 甘达董事经理拟上诉

（吉隆坡6日讯）甘达集团（KAMDAR，8672，主板贸服股）家族纷争再升级，董事经理卡马尔古马在高庭对大股东撤销控诉后，将考虑提出上诉。

吉隆坡高庭在上周三（1日）宣布，撤销甘达集团子公司甘达私人有限公司（KSB），对公司大股东毕频查达巴瓦尼、前总执行长再也斯甘达拉和承包商叶锦宏（译音）的起诉。

卡马尔古马接受财经日报《The Edge》访问时称：“我会跟律师商量，我们正考虑对高庭的判决提出上诉。”

该报道也引述消息指出，其他家庭成员有意从中调解纠纷，不过两方人马都不愿与彼此交流。

根据早前资料，卡马尔古马入禀高庭，起诉上述3人涉嫌从公司盗提880万令吉，并把其中的570万令吉，用于收购公司股票。

不过，高庭在上周三指出，账目显示从甘达集团提出的880万令吉，是用作贷款给已经在2008年逝世的创办人兼前主席哈苏卡拉。

高庭根据证据表示，这笔款项的确是用来贷款给哈苏卡拉，因此宣判毕频查达巴瓦尼和再也斯甘达拉并无违法。

同时，用来偿还这项贷款的款项，也已经注入KSB的户口，没有招致任何损失。

所以高庭宣布，撤销KSB对上述3人的起诉。

甘达集团的家庭纠纷，源自毕频查达巴瓦尼在2年前，有意将卡马尔古马逐出董事部。

毕频查达巴瓦和卡马尔古马拥有表亲关系，各持公司28.9%和27.01%股权，后者是第2大股东。

在成功捍卫董事部地位后，卡马尔古马去年4月委任MessrsMorison Anuarul AzizanChew为特别审计师，来调查KSB的账目。【南洋网财经】

甘达与前律师诉讼和解

（吉隆坡23日讯）甘达集团（KAMDAR，8672，主板贸服股）和前律师的诉讼案，双方同意以5万令吉和解。

文告指出，双方是在本月8日达成和解判决，为这项诉讼案划上句点。

起诉人为甘达集团的前律师周麦克律师楼，于今年6月3日在推事庭入禀诉状，向甘达集团索偿9万3541令吉、堂费及其他法庭认为适当的赔偿。【南洋网财经】

高庭重审甘达子公司诉讼案

（吉隆坡13日讯）高庭须重审甘达集团（KAMDAR，8672，主板贸服股）子公司甘达私人有限公司（KSB）与前主席毕频查达巴瓦尼及其他二人的纷争。

根据文告，上诉庭宣布无效审判（mistrial），并勒令高庭另一名法官重新审理。

高庭去年7月宣布，撤销KSB对公司大股东毕频查达巴瓦尼、前总执行长再也斯甘达拉和承包商叶锦宏（译音）的起诉，并须支付每人各6万令吉的诉讼费用。

上述3人涉嫌从该公司盗提880万令吉。

2014年4月，该集团委任独立审计师，协助调查盗提公司款项的事件。

审计结果显示，2名甘达集团的前职员从2005年3月23至26日之间共有4项非商业提款，总值884万令吉。

KSB于2014年10月起诉毕频查达巴瓦尼、再也斯甘达拉和叶锦宏，利用上述款项来收购集团股票。

高庭根据会计记录表示，这笔款项是用来贷款给该集团已逝世的创办人哈苏卡拉，同时，款项已经注入KSB的户头，没有造成损失，因此，高庭当时宣判毕频查达巴瓦尼和再也斯甘达拉并无违法。 【e南洋】
