你们的Contract有这一条吗？

最近拿到工作offer， 但是contract里面有一条statement很过分。 不知道你们的contract有这条吗？

Article 6 - non competition

6.1 in consideration of the Salary paid to employee by the Company, the employee agrees that during the Term and for a period of two (2) years following the termination or expiration of this Agreement (for whatever reason):

(b) unless expressly consented to by the Company, Employee will not assume employment with or provide services for any competitor of the Company, or engage, whether as principal, partner, licensor or otherwise, in any business which is in direct or indirect competition with the business of the company; and

之前好像有人问过类似的问题。。

不用担心啦。。
如果有一天你真的辞职而join competitor 的公司，
他不能拿你怎样。。。
因为offer letter 并无列明哪一间是他们的competitor,
也没有列明competitor 的公司名字。。

甚么类型的公司？chinaman company?
一般企业不会在意员工辞职后去competitor的公司。。
人来人往本来就很平常。。
join 了competitor 的公司后再回来的也是大把。。

哈哈。。。算radius范围的也有啊。。。就比如说在公司2km范围里面的相关公司你不能去就职的条件。。。你看过吗？

你是什么 level?
这种 restraint of trade 的 clause 在很多情況下是 void and illegal, ie 无效.
例子:
STAMFORD COLLEGE GROUP v RAJA ABDULLAH RAJA OTHMAN [1991] 2 CLJ 167

理由很簡單, 員工还是要吃飯的.

因为我想在这间公司做一两年后跳槽吗。。。所以怕說签了这个agreement后会有麻烦。

如果你的 level 夠高, 如CEO, CIO 等有看到一些商业秘密, 这個 clause 是可以 enforce的.

很多公司都有類似的條件啦.. 你可以不簽囉.. 提前.. 現在找工難哦...
