Type | Announcement | Subject | OTHERS | Description | UPDATES ON WRIT OF SUMMONS SERVED ON MALAYSIA AIRPORTS HOLDINGS BERHAD | We refer to the article titled ‘MAHB Should Explain What Happened’ appearing in The Edge Malaysia on 28 January 2019.
Firstly, we wish to highlight that all material disclosures and material developments that may change or affect the outcome of all legal actions have been made promptly by the Company and in a timely manner as required by Bursa Malaysia.
Normally, any material amendments in a Statement of Claim or Defence require leave from the Court. However, in relation to Syarikat Pembinaan Anggerik Sdn Bhd (SPASB)’s Amended Statement of Claim (“Amended SOC”), the amendments therein were made without the need for leave from the High Court. In addition, the amendments were made prior to the close of pleadings and before MAHB had filed its Defence.
Therefore, it is the Company’s view that the amendments made by SPASB through the Amended SOC are not considered as material development since it did not affect or change the outcome of the legal action or bring any severe impact to the Company as the amount claimed is subject to proof at the full trial of this case which is fixed in June 2019. Accordingly, the Company did not disclose the changes made by SPASB via the Amended SOC.
In reference to the Amended SOC, we wish to clarify that SPASB had changed its claims from RM43,992,292.78 to RM59,853,361.93. Such changes are largely made to the figures for two heads of claims, i.e. “Balance of Works” and “Interest charges”, which are often done in construction disputes.

Further to the announcement above, MAHB wishes to announce that via a letter dated 10 April 2019 from Ministry of Transport, the Government of Malaysia has approved and granted MAHB the following: - Extension of the OA for an additional thirty-five (35) years from the existing twenty-five (25) years up to 11 February 2069 giving the rights to MAHB to continue operating, managing and maintaining the existing 39 airports and short take-off landing airports (STOLport) in Malaysia for a total of 60 years from 12 February 2009.
- The current OA and Lease Agreements will be superseded and replaced with four (4) new OA which are the OA For KLIA, OA For Designated Airports in Peninsular Malaysia, OA For Sabah Airports and OA For Sarawak Airports (collectively known as “New OAs”) and new Lease Agreements, respectively.
Further announcement will be made once the New OAs and new Lease Agreements have been signed.

The Judicial Review Application is purportedly for inter alia an Order of Mandamus to compel the Commission to commence mediation to resolve the disputes between the Applicants and MA Sepang.
MA Sepang has yet to be served with any documentation regarding the Judicial Review Application and no further comment can be provided by the Company at this juncture.
The Judicial Review Application is not expected to have any material impact on the financial and operational position of the Company.
Any further updates in respect of any material development will be made from time to time.
